1. Agreement to Terms
By accessing or using the services provided by Kate Ekphiwre Memorial Hospital Ltd, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services or website. These terms apply to all patients, accompanying persons, visitors, and users of our hospital facilities and digital platforms.
2. Our Services
Kate Ekphiwre Memorial Hospital (Kate Ekphiwre Memorial Hospital) provides regulated hospital services in Warri, Delta State, including emergency and critical care, specialist consultations, general and orthopaedic surgery, obstetrics and gynaecology, paediatrics and neonatology, internal medicine, laboratory diagnostics, pharmacy services, and telemedicine. All clinical services are delivered by qualified and MDCN/NMCN-registered healthcare professionals. Each service may be subject to additional terms communicated at the time of engagement.
3. Clinical Information & Website Content
General health information published on our website is intended for informational purposes only. It does not constitute a clinical diagnosis, a prescription, or a substitute for a face-to-face consultation with a qualified doctor. Clinical decisions are made solely by our registered healthcare professionals during a direct patient encounter. If you have a medical concern, contact us or present at the hospital immediately.
4. Patient Rights & Responsibilities
Patients have the right to receive respectful, dignified, and person-centred care; to be informed of their diagnosis and treatment options in plain language; to give or withhold informed consent before any procedure; and to have their personal and medical information kept confidential in accordance with our Privacy Policy. Patients are responsible for providing accurate and complete medical history, following clinical guidance given by our staff, and settling applicable fees in accordance with our Payment Policy.
5. Consent to Treatment
By presenting at Kate Ekphiwre Memorial Hospital for clinical care, you consent to examination and routine treatment by our medical team. For invasive procedures, surgery, or anaesthesia, separate written informed consent will be obtained from the patient or their legal guardian before the procedure commences. In life-threatening emergencies where the patient is unable to consent and no legal guardian is immediately available, Kate Ekphiwre Memorial Hospital will proceed with treatment in the patient's best clinical interest, in accordance with Nigerian medical ethics and law.
6. Fees and Payments
All fees for consultations and clinical services are clearly stated on our booking platform or provided via formal invoice. Payment is due before or at the time of service delivery, unless a formal credit arrangement has been agreed in writing. Online payments are processed securely through Paystack. Kate Ekphiwre Memorial Hospital also accepts cash, POS, bank transfer, USSD, mobile money, and accredited HMO and health insurance. Full details are set out in our Payment Policy.
7. Limitation of Liability
To the maximum extent permitted by Nigerian law, Kate Ekphiwre Memorial Hospital Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or our website. Nothing in these terms limits Kate Ekphiwre Memorial Hospital's liability for clinical negligence, death, or personal injury caused by the proven fault of our staff, as governed by Nigerian law.
8. Complaints Procedure
Kate Ekphiwre Memorial Hospital is committed to resolving patient concerns promptly, fairly, and with confidentiality. If you are dissatisfied with any aspect of your care or experience, please speak with the ward sister or department head during your visit, or contact us in writing at info@kemhospital.net. Formal complaints will be acknowledged within five working days and investigated in accordance with our internal complaints policy and HEFAMAA accreditation standards.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria. The primary registered place of business of Kate Ekphiwre Memorial Hospital Ltd is 1 Ekphiwre Drive, Off Enerhen Road, Warri 330102, Delta State, Nigeria.
